Russ August & Kabat NewsRuss August & Kabat won a reversal of a patent claim construction ruling from the United States Court of Appeals for client HBAC Matchmaker Media against Google, Yahoo, and several major media companies. The case was argued by Russ August & Kabat attorney Brian D. Ledahl. The appeal involved a claim construction ruling requested by Google and other defendants in the district court. The Federal Circuit reversed that ruling and adopted the claim construction advocated by Russ August & Kabat in the case. See Opinion.

Federal Circuit Adopts Position Advocated in Russ August & Kabat Amicus Brief On Key Patent Issue April 2016

Russ August & Kabat NewsRuss August & Kabat attorneys Brian D. Ledahl and Marc A. Fenster submitted an amicus brief on behalf of a number of patent holders to the U.S. Court of Appeals for the Federal Circuit in connection with an important patent case addressing venue for patent suits. The case, In re TC Heartland, LLC, raised the issue of where patent infringement suits could be brought. Russ August & Kabat submitted an amicus brief arguing that the relevant federal statute provided that such cases could be brought in any district where the defendant was subject to personal jurisdiction, a position that the Federal Circuit adopted in its precedential opinion. The case drew significant interest from many other amici, including the Electronic Frontier Foundation, Google, Ebay, HP, and many others. Russ August & Kabat submitted the only amicus brief supporting patent holders in the case and advocating the position ultimately adopted by the Federal Circuit.

Russ August & Kabat NewsRuss August & Kabat Expands Its Intellectual Property Department with Addition of Partner Neil A. Rubin and Associates Arka D. Chatterjee and Justin E. Maio.

Russ August & Kabat is pleased to announce that Neil A. Rubin, Arka D. Chatterjee and Justin E. Maio have joined the firm’s litigation and intellectual property departments, as partner and associates, respectively.

Mr. Rubin’s practice focuses on patent, trade secret and other intellectual property litigation, for clients in the computer security, networking, electronics, software and financial industries. He has litigated patent, trade secret, copyright and antitrust matters in the district courts, International Trade Commission and before the Patent Trial and Appeal Board, from the pre-suit investigation stage through appeal.

Prior to joining Russ August & Kabat, Mr. Rubin was a lawyer at Latham & Watkins from 2006 to 2016, where he was a member of the Litigation & Trial Department’s Intellectual Property Litigation practice group. Mr. Rubin earned his law degree from Stanford University Law School. He also holds physics degrees from Stanford, Cambridge and Case Western Reserve Universities. He was awarded a National Science Foundation Graduate Research Fellowship and attended Cambridge University as a Churchill Scholar. As a PhD student at Stanford, his area of research was solid state physics. Mr. Rubin was an award-winning teaching assistant, and his PhD advisor was 1998 Nobel Prize winner Robert Laughlin.

Mr. Chatterjee’s practice focuses on patent litigation in a wide range of technologies. He has litigated disputes involving DNA sequencing, bioinformatics, geophysics and seismology, semiconductor design and fabrication, network design and security, and software. Complementing his patent litigation expertise, Mr. Chatterjee has handled copyright and trademark matters for clients in the entertainment and garment industries.

Prior to joining Russ August & Kabat, Mr. Chatterjee was an attorney with the law firms of Simpson Thacher & Bartlett LLP, and Irell & Manella LLP. Before earning his law degree from Columbia Law School, where he was a Harlan Fiske Stone scholar, he worked as a researcher in the life sciences, exploring the etiology of and treatments for various inflammatory diseases and cancer.

Mr. Maio’s practice focuses on trademark prosecution and related matters. He has filed, prosecuted and defended trademarks before the United States Patent & Trademark Office and secured trademarks for clients internationally.

Prior to joining Russ August & Kabat, Mr. Maio was an attorney for Keegan & Baker, LLP in real-estate litigation and Associated Production Music, LLC, where he focused on royalty agreements. He earned his law degree from Pepperdine University School of Law with a Dean’s Merit Scholarship and was awarded CALI Certificates in Contracts and Mediation Theory & Practice. He also earned a Certificate in Dispute Resolution from the Strauss Institute for Dispute Resolution, which is ranked as the top program of its kind in the nation. Mr. Maio is a registered as a patent attorney before the United States Patent & Trademark Office.

While at Loyola, Mr. Chung was the Technology Editor of the Loyola Law Review. He earned his Bachelor of Science in Operations Research and Industrial Engineering from Cornell University.

Nathan D. Meyer’s practice focuses on general litigation and intellectual property matters, with an emphasis on general business litigation and soft IP. His experience includes copyright, apparel, contract and real estate litigation. Mr. Meyer is a graduate of Harvard Law School and Harvard College.

Reza Mirzaie’s practice focuses on various areas of intellectual property litigation, including patent, trademark, and trade secret litigation. He has litigated patent and trade secret disputes involving a variety of technologies, including computer software, hardware, digital signal processing, and elevator dispatch systems. Mr. Mirzaie is a registered patent attorney licensed to practice before the United States Patent & Trademark Office. Complementing his litigation expertise, he has worked on numerous prosecution and post-grant matters before the USPTO. Mr. Mirzaie earned his law degree from University of Illinois College of Law, where he was the Associate Editor of the University of Illinois Law Review. He earned his Bachelor of Science degree in Electrical Engineering from University of Southern California.

Jean Y. Rhee’s practice focuses on intellectual property, business litigation, and counseling on matters of corporate governance, employment, and white collar crime.  Ms. Rhee has represented numerous Fortune 100 and 500 clients, including Shell Oil, Hewlett Packard, Merrill Lynch, and Fidelity.  Ms. Rhee received her J.D., magna cum laude, from the University of Michigan law school, where she was an Articles Editor for the Michigan Law Review, Order of the Coif, and a member of the Campbell Moot Court Board.
