Russ August & Kabat Expands Its Intellectual Property Department with Addition of Partner Amir A. Naini.
Russ August & Kabat is pleased to announce that Amir A. Naini has joined the firm as a partner in the firm’s litigation and intellectual property departments.
Mr. Naini earned his law degree from the UC Berkeley Boalt Hall School of Law. He earned a Ph.D. in biochemistry from Brandeis University and a BA in biochemistry from Swarthmore College. Prior to joining Russ August & Kabat, Mr. Naini was counsel at Irell & Manella LLP, where he was a member of the Intellectual Property and Litigation workgroups. Mr. Naini specializes in representing life sciences and high technology clients in litigation, transactions, and strategic counseling involving intellectual property rights, with an emphasis on patent-related matters.

Russ August & Kabat trial lawyers Jules L. Kabat, Matthew A. Rips, and Michael T. Boardman won an eight figure actual damages, treble damages and punitive damages fraud and conspiracy judgment in the Los Angeles Superior Court vindicating their investor clients who were defrauded into purchasing certain improved and leased commercial real property. The judgment also awarded all attorney’s fees and costs.
The judgment was against the non-settling defendants, and was in addition to a seven figure settlement with the other defendants. RAK discovered that the clients had been given incomplete and misleading information about the property, and prosecuted and won a case establishing that the defendants conspired to commit fraud and defrauded the clients. RAK not only won the resulting damages suffered by the clients, but also obtained awards of treble damages and punitive damages due to the nature of the conspiracy and fraud. RAK also obtained an award of all attorney’s fees and costs for the client.
Russ, August & Kabat lawyers Marc A. Fenster, Alexander C.D. Giza, Adam S. Hoffman, Benjamin T. Wang, Paul A. Kroeger and Michael T. Boardman, on November 23, 2013, won a multi-million dollar patent infringement verdict against Newegg, Inc. for TQP Development, LLC, after a week-long jury trial in the United States District Court for the Eastern District of Texas.
Newegg is the second largest online retailer, insists that it never settles, and touted the case as the strongest it had ever taken to trial. The jury found that Newegg, directly and indirectly, infringed TQP’s patent on encryption methods, and affirmed the validity of TQP’s patent. The jury rejected all of Newegg’s asserted defenses and prior art references, over the testimony of four alleged prior art inventors and Newegg’s expert witnesses, including cryptography expert and purported inventor of public-key cryptography, Dr. Whitfield Diffie. Newegg was represented by lawyers from Weil Gotshal & Manges LLP, Bracewell & Giuliani LLP, The Webb Law Firm, Fish & Richardson, and Yarbrough Wilcox Gunter PLLC.

The United States Supreme Court today denied certification of Hyundai Motor America, Inc.’s petition for writ of certiorari challenging a $20 million judgment obtained by Russ August & Kabat attorneys Marc A. Fenster, Jules L. Kabat, Alexander C.D. Giza, Adam S. Hoffman, and Benjamin T. Wang on behalf of their client, Clear With Computers, LLC.
Hyundai requested that the Court grant its petition, vacate the Federal Circuit’s summary affirmance, and remand for further proceedings. Hyundai was represented by Paul Clement and the international law firm of Winston & Strawn.
