Bradley A. Hyde

Bradley represents clients in high-stakes patent and trade secrets litigation.  He has successfully litigated cases in every major patent venue across the US, including district courts, the International Trade Commission (ITC), the Patent Trial and Appeal Board (PTAB), as well as before the Federal Circuit, the D.C. Circuit, the Ninth Circuit, and the Supreme Court, both as plaintiff and defense counsel.

Bradley has significant trial experience. In 2024, Bradley helped lead a team to obtain a full victory in the International Trade Commission in a medical device case for Complainant Serendia LLC, initially involving 6 patents asserted against 8 different entities. Bradley presented Complainant’s technical expert for one of the primary patent families, and cross-examined multiple respondent experts, resulting in a finding that all asserted claims were infringed and valid.

Prior to that, in 2022 and 2023, Bradley helped lead a team to obtain a full victory in the International Trade Commission in a case involving garage door operators and accessories for Complainant The Overhead Door Corporation, against its primary competitor The Chamberlain Group, LLC.  There Bradley presented multiple fact and expert witnesses, and cross-examined multiple respondent fact and expert witnesses, once again resulting in a finding that all asserted claims were infringed and valid.  Parallel to these ITC actions, Bradley also helped lead a team to successfully defend against a patent infringement action filed by The Chamberlain Group LLC against The Overhead Door Corporation in the Western District of Texas before Judge Rodney Gilstrap.

Bradley has also successfully litigated trade secrets cases, including LG Chem’s landmark 2020 win at the ITC in its high profile trade secrets case against SK Innovation on electric car batteries, resulting in a $1.8 billion settlement between SK Innovation Co. and LG Energy Solutions.

Bradley also has significant experience helping veterans, immigrants, and victims of domestic violence as part of his pro bono practice.   For example, in 2023, Bradley won a precedent-setting Veterans’ Disability case before the D.C. Circuit in Jason Sissel v. Christine Wormuth, No. 22-5045 (D.C. Cir. 2023), resulting in a nation-wide shift to how the military’s physical disability review board awards disability payments to veterans.  Bradley similarly won victories before the Ninth Circuit in multiple immigration Asylum cases, including Ayala v. Sessions, No. 13-72250 (9th Circuit 2017) and Toure v. Garland, No. 20-72920 (2021).

Prior to joining Russ August & Kabat, Bradley worked as an attorney at Latham & Watkins, where he litigated IP cases for over 10 years.

Prior to becoming an attorney, Bradley served as an officer in the United States Army and was deployed in support of Operation Enduring Freedom in Afghanistan.  Bradley also worked for Raytheon Missile Systems.

  • Enplas Display Device Corp. et al. v. Seoul Semiconductor Ltd., No. 13-05038, as counsel for Seoul Semiconductor Ltd., resulting in a full victory before a jury in the Northern District of California, finding all patent claims infringed and valid.
  • Enerpol v. Schlumberger, as counsel for Schlumberger involving fracking technology, obtained a complete defensive victory after successfully winning key claim construction disputes.
  • Certain Digital Video Receivers And Related Hardware And Software Components, Inv. No. 337-TA-1103, as counsel for Respondent Comcast Corporation in an action involving digital video receivers, resulting in a favorable settlement.
  • Certain Tobacco Heating Articles and Components Thereof, Inv. No. 337-TA-1199, as counsel for Respondents Philip Morris and Altria Group, Inc. in an action involving electronic vaping technologies, resulting in a favorable settlement.
  • Counsel for Amphenol Corp. involving cellular antenna technologies, in an indemnity matter arising out of an infringement suit filed against Verizon, resulting in a favorable settlement.
Joshua M. Scheufler

Joshua M. Scheufler

Joshua Scheufler is an associate at Russ August & Kabat, focusing on intellectual property litigation. Previously, Joshua served as the law clerk to the Honorable Magistrate Judge Roy S. Payne.

Joshua has represented companies on both sides of the “v” across a variety of technological fields including speech-recognition, natural language processing, user-interface design, cryptographic security, secured payment methods, cardiac monitoring medical devices, fiber optics, cloud networking, and video compression. Joshua has experience in all stages of district court litigation as well as both inter parties review and ex party review.

Joshua graduated from the University of Texas School of Law, where he served as the Executive Submissions Editor of the Texas Intellectual Property Law Journal. He also received a bachelor’s degree in mechanical engineering, cum laude, from the University of Houston.

Mackenzie R. Paladino

Mackenzie R. Paladino

Mackenzie is a dedicated associate who specializes in IP litigation. Mackenzie earned her Juris Doctor from Washington University in St. Louis, where her work was published in the Washington University Jurisprudence Law Review. During law school, she also participated in a legal clinic that provided post-conviction representation to wrongfully convicted death row inmates in Philadelphia. This early exposure to impactful legal work instilled in her a passion for justice and courtroom advocacy. 

After law school, Mackenzie clerked for the Honorable Juan F. Alanis in the United States District Court for the Southern District of Texas. Before joining RAK, Mackenzie was a litigation associate at a boutique entertainment law firm in New York City. There, she represented a wide-variety of artists and entertainers in copyright and trademark matters, focusing on protecting their creative works and intellectual property rights. 

Dale Chang

Dale Chang

Dale represents clients in high-stakes patent and trade secrets litigation. He has successfully litigated cases in every major patent venue across the US, including district courts, the International Trade Commission (ITC), and the Patent Trial and Appeal Board (PTAB), both as plaintiff and defense counsel.

Dale has played significant roles in over 20 trials. In 2024, Dale, Marc Fenster, and Reza Mirzaie led the RAK team that won a $262 million jury verdict, and a resulting judgment of $380 million, against Western Digital on patents related to magnetic recording media in hard disk drives. Dale presented plaintiff MR Technologies’ infringement and validity expert, and the jury found all five asserted claims infringed and valid.

In 2022, Dale notched three trial wins in a row, starting with a complete defense victory for Irving Consumer Products against First Quality in an April 2022 Delaware jury trial on tissue products. That was followed by a plaintiff-side win for Philip Morris in a June 2022 Virginia jury trial against RJ Reynolds on vaping devices. Dale capped the year off with a complete defense victory for SMR against Magna in a December 2022 Michigan jury trial on side-view car mirrors.

In addition to his recent jury wins, Dale first-chaired a PTAB trial in a pivotal IPR of a patent on which the patentee had prevailed at the ITC. The PTAB found all claims invalid in January 2022. Earlier that month, Dale obtained another complete victory from the PTAB, in a post grant review of a patent asserted in district court. He has since first-chaired several other PTAB trials with a 100% win rate.

Dale has also successfully litigated trade secrets cases, including LG Chem’s landmark 2020 win at the ITC in its high profile trade secrets case against SK Innovation on electric car batteries.

Other notable achievements include 2018, 2016, and 2014 jury wins in the Eastern District of Virginia and the District of Delaware as well as major victories at the ITC in 2020, 2017, and 2015.

Prior to joining Russ August & Kabat, Dale was counsel at Latham & Watkins, where he litigated IP cases for over 15 years.

Other representative matters include:

  • InterDigital v. ZTE, as counsel for InterDigital in asserting three patents relating to 3G and Wi-Fi technologies; jury found all asserted claims infringed and valid.
  • Xperi v. Samsung, as counsel for Xperi entities in cases involving semiconductor technologies, which resulted in a favorable settlement that boosted Xperi’s stock price by over 40%.
  • Counsel for AMD in its cross-license dispute with Intel, in which Intel agreed to pay US$1.25 billion to AMD to settle all disputes between the parties.
  • Symantec v. Computer Associates, as counsel for Symantec in a patent case on anti-virus technology; obtained favorable settlement after winning key claim construction disputes.
Peter Tong

Peter Tong

Peter Tong is a partner at Russ August & Kabat, focusing on intellectual property litigation with an emphasis on matters in the Western District of Texas, where he previously served as the law clerk to the Honorable Judge Alan D. Albright.

Peter has represented companies in numerous patent lawsuits and helped a client secure a jury verdict for hundreds of millions of dollars.  He has won inter partes review (IPR) proceedings before the USPTO and matters for both plaintiffs and defendants before federal courts.  In addition to patent litigation, Peter has also handled cases regarding the theft of trade secrets and breach of confidentiality.

Peter filed and managed hundreds of patent applications in a variety of fields including computer architecture, memory design, analog circuits, digital circuits, processors, online searching, online advertising, software, semiconductor fabrication, cooling systems, power devices and circuits, power generation and distribution systems, server systems, mobile devices, semiconductor materials, and wireless communications devices. He also represented clients by drafting patent applications, responding to office actions, filing appeals, advising on strategies for broadening patent portfolio protection, writing freedom to operate opinions, performing patent searches, and assisting startups to acquire initial patent protection for their products.

Before completing his law degree at the University of Texas at Austin, Peter worked on computer architecture at Hewlett Packard and on electronic systems at Raytheon Corp.  He graduated summa cum laude with an electrical engineering degree at the University of Texas at Dallas.

Daniel B. Kolko

Daniel B. Kolko

Daniel B. Kolko is a litigation associate at Russ August & Kabat.

Daniel is a graduate of the University of California, Irvine School of Law. While in law school, he served as a research fellow to Professor Beatrice A. Tice and provided pro bono legal assistance to Public Counsel. Daniel also competed in the moot court competition and participated in UCI’s Consumer Law Clinic.

Prior to law school, Daniel worked in the conflicts department at Latham & Watkins. Daniel holds a Bachelor’s degree in Political Science from the University of California, Los Angeles.
