Neil A. Rubin‘s practice focuses on patent, trade secret and other intellectual property litigation, for clients in the computer security, networking, electronics, software and financial industries. He has litigated patent, trade secret, copyright and antitrust matters in the district courts, International Trade Commission and before the Patent Trial and Appeal Board, from the pre-suit investigation stage through appeal. Mr. Rubin earned his law degree from Stanford University Law School. He also holds physics degrees from Stanford, Cambridge and Case Western Reserve Universities. He was awarded a National Science Foundation Graduate Research Fellowship and attended Cambridge University as a Churchill Scholar. As a PhD student at Stanford, his area of research was solid state physics. Mr. Rubin was an award-winning teaching assistant, and his PhD advisor was 1998 Nobel Prize winner Robert Laughlin.
Philip X. Wang specializes in patent litigation and PTAB proceedings, with a focus on high-technology. His practice centers on large, complex patent litigations. He has represented clients in the semiconductor, computer software, and pharmaceutical industries. He has trial experience before district courts, the International Trade Commission, and the Patent Office. Mr. Wang earned his law degree from Columbia Law School, where he was a Harlan Fiske Stone scholar. He is a registered as a patent attorney before the United States Patent & Trademark Office.

Russ August & Kabat attorneys Marc Fenster, Reza Mirzaie, Ben Wang, Adam Hoffman, Neil Rubin, James Pickens and Jacob Buczko won a jury verdict for their client, Core Wireless, against Apple for the infringement of two Core Wireless patents. The patents are part of a portfolio of Nokia patents relating to fundamental cellular technology.
The jury agreed that Apple’s iPhones and iPads were infringing both asserted patents, and rejected Apple’s invalidity arguments. The jury awarded $7.3M in damages.
Notably, the jury verdict represents the first multi-million dollar jury award against Apple in the Northern District of California, where Apple resides.
The patents asserted in the trial against Apple are U.S. Patent No. 6,477,151, which relates to an improved protocol for resolving propagation delay and U.S. Patent No. 6,633,536, which relates to an improved signaling protocol designed to improve network operation and call reliability.
The verdict vindicates years of licensing efforts by Core Wireless and its parent company, Conversant Intellectual Property Management, Inc. Following the favorable verdict, Conversant CEO John Lindgren commented: “We are incredibly pleased with the persuasive way the RAK trial team tried the case. They faced a formidable opponent in Apple and WilmerHale LLP. This win follows an earlier jury verdict for Core Wireless that RAK won against LG and their attorneys at Sidley Austin LLP. In September 2016, the RAK team won a verdict that LG had willfully infringed two Core Wireless patents. That resulting judgment was later enhanced by the Eastern District of Texas Court—the first enhancement decision ever in a case involving standards-essential patents.
The cases are: Core Wireless Licensing S.A.R.L. v. Apple, Inc., Case No. 5:15-cv-05008-NC and Core Wireless Licensing S.A.R.L. v. LG Electronics, Inc., Case No. 2:12-cv-912.
Russ, August & Kabat attorneys Marc A. Fenster, Reza Mirzaie, Adam Hoffman, Neil Rubin, Jacob Buczko and James Pickens won a jury verdict of willful patent infringement of two standards-essential cell phone patents by LG Electronics, for their client, Core Wireless. The cell phone patents: Patent No. 7,804,850, related to improved battery life through reduction in superfluous transmissions, and Patent No. 6,633,536, related to a signaling protocol designed to improve network operation and call reliability.
While the jury awarded only $2.28 million for past damages, it also awarded a running royalty on both patents that could translate into millions of dollars through 2028, the expiration date of the ‘850 patent. In a rather rare event, the jury also found that LG willfully infringed Core Wireless’ Standards-Essential Patents, subjecting LG to enhanced damages and the real possibility of Core Wireless recovering its attorney’s fees from LG.
The verdict vindicates years of negotiation efforts by Core Wireless and its parent company, Conversant Intellectual Property Management, Inc. Following the favorable verdict, Conversant CEO John Lindgren commented: “We are very pleased with the skillful and persuasive way the RAK trial team distilled this complex technology to the clearest of terms.
